Terms of Service

Last updated: November 3, 2026. Effective: November 3, 2026.

Kabkan LLC, a Texas limited liability company ("Kabkan", "we", "us" or "our"), operates the Kabkan service. These Terms of Service are an agreement between you and Kabkan LLC.

Commercial Documents — Not Fiscal Invoices

Kabkan is designed solely for operational project quoting, customer agreement confirmation, and commercial invoice issuance. Documents produced by this software are NOT certified fiscal, tax, or government-mandated electronic invoices. Each business entity is exclusively responsible for complying with applicable local tax laws, VAT/sales tax registration, and statutory bookkeeping obligations.

1. Agreement

These Terms are a contract between you and Kabkan LLC. You accept them when you create an account and tick the box to agree, or when you use Kabkan. If you do not agree, do not use Kabkan.

If you use Kabkan for a business, "you" means you and that business, and you confirm that you have authority to bind it. Our Privacy Policy explains how we handle personal information.

2. Eligibility

You must be at least 18 years old and able to make a binding contract.

Kabkan is for business use: to quote and invoice for your trade or business. It is not for personal, family or household use.

Kabkan is intended for businesses in the United States.

You may not use Kabkan if you are barred from receiving services under US law, including US sanctions.

3. Accounts and security

Give us accurate information and keep it current. You must verify your email address. One account is for one person: do not share your login; invite team members instead.

Keep your password and devices safe, and turn on two-factor authentication. You are responsible for what happens under your account and for the roles you give team members. Tell us right away at support@kabkan.com if you think your account was misused.

We keep each organization's data separate in our database, but no system is perfectly secure.

4. The service

Kabkan helps service businesses create quotes and invoices, share them by link or email, record payments they receive and manage their catalog.

Kabkan does not process your customers' payments and does not file or collect taxes. Documents made with Kabkan are commercial documents, not certified fiscal or electronic tax invoices.

5. Free plan, plans and changes

The Free plan has no time limit. It has the limits shown on our pricing page. Paid plans add higher limits and features.

"Unlimited" means no fixed monthly cap, for use in your own business in good faith. We may contact you about, or limit, use that harms the service or other users.

We may change features, limits and prices. We will give at least 30 days' notice by email or in the app before a change that reduces what your plan includes, including the Free plan's limits, or raises its price. A price change applies to paid plans from your next renewal after the notice.

If we ever stop offering Kabkan, we will give at least 60 days' notice so you can export your data.

6. Paid plans and billing

Paid plans (Plus and Premium) are not available to buy yet. Nothing is charged today. Before paid plans become available, we will update these Terms with the billing terms that will apply to them.

7. Your content and your customers' data

You own the content you put in Kabkan: your business details, customers, catalog, terms, quotes, invoices and files.

You give Kabkan LLC a license to host, copy, process, send and display that content only to provide, secure and support Kabkan for you, and as the law requires.

You are responsible for your content and for having the right to enter your customers' personal information and to send them documents. For that information we act as your service provider (processor): we process it on your instructions and as our Privacy Policy describes.

Owners and Admins can export the organization's data as a JSON file at any time from Settings.

8. AI features

AI Refine sends the text you choose (for example a product description, a term or a disclaimer) to our AI provider, Google, to suggest new wording. Do not include personal, confidential or sensitive information.

Suggestions can be wrong, incomplete or unsuitable for your situation. Check them before you use them. They are not legal or professional advice.

Each plan includes a number of AI credits. Unused credits do not carry over and have no cash value.

9. No legal, tax or accounting advice

Kabkan is a tool. We do not give legal, tax or accounting advice. You decide your prices, tax rates, terms, invoice content and numbering.

You are responsible for meeting the rules that apply to your business, including tax registration and filing, invoice requirements, consumer and contractor laws, and keeping records for as long as the law requires. We do not promise that a document made with Kabkan meets the requirements of any place.

10. Sending documents and sharing links

When you send a document by email or share a link, you are the sender. Emails show your business name, and replies go to your organization's email address when one is set.

Send documents only to people you do business with, and only for that business. Do not use Kabkan to send advertising or bulk email. You are responsible for following anti-spam and privacy laws (such as CAN-SPAM) and for the accuracy of what you send.

Share the access code only with the intended recipient. We may limit, delay or stop sending to protect our service, our email reputation or recipients.

11. Acceptable use

Do not:

  • break the law or help others to break it;
  • send fraudulent, misleading or harassing documents;
  • send spam or upload malware;
  • try to access other organizations' data or accounts;
  • probe, scan or test our security without our written permission (report security issues to support@kabkan.com);
  • overload or disrupt the service, or scrape or copy it;
  • reverse engineer it, except where the law allows;
  • resell Kabkan or provide it to others as a service;
  • create accounts by automated means or to get around limits; or
  • use another person's identity.

12. Suspension and termination

You can stop using Kabkan and delete your account or organization at any time.

We may suspend or end your access if you break these Terms, if your use creates risk or legal exposure for us or others, or if the law requires it. Where it is practical and lawful, we will tell you first and give you a chance to fix the problem.

If we end your access for a reason other than a serious or repeated breach, we will give you 30 days to export your data first.

13. Deleting your account or organization

The Owner can delete an organization in Settings. By default it is deleted after a waiting period of 14 days from the request. Until then it is read-only, its shared links stop working and the Owner can cancel. The Owner can also delete it immediately, which cannot be undone.

Deleting an organization removes its data for all members and cancels any subscription, with no refund.

You can delete your own account in Settings. It is deleted right away. If you are the only Owner of an organization that has other members, business data or a paid plan, you must first make someone else Owner or delete that organization.

Records you created in organizations you leave stay with them, shown as "Deleted user". Deletion is permanent: export what you need first. Some data remains for a limited time, as our Privacy Policy explains (for example backups until they expire, and payment records the payment provider must keep).

14. Our rights, feedback and open source

Kabkan, our software, design, name and logo belong to Kabkan LLC or its licensors. These Terms give you a right to use Kabkan, not ownership of it.

If you send us ideas or feedback, we may use them without paying you. Some parts of Kabkan are open-source software under their own licenses.

15. Availability and backups

We work to keep Kabkan available and to back it up, but we do not promise that it will always be available or error-free, or that data can always be restored. We may pause it for maintenance.

Keep your own copies of important records, for example with the export.

16. Third-party services

Kabkan relies on other companies, such as hosting, email, payment and AI providers. We are not responsible for their services. Links to other sites are for convenience.

17. Disclaimers and limitation of liability

KABKAN IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT THE LAW ALLOWS, KABKAN LLC GIVES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

TO THE EXTENT THE LAW ALLOWS, KABKAN LLC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, EVEN IF WE WERE TOLD THEY WERE POSSIBLE, AND EVEN IF CAUSED BY OUR NEGLIGENCE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT KABKAN IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND $100.

THESE LIMITS DO NOT APPLY WHERE THE LAW DOES NOT ALLOW THEM, FOR EXAMPLE FOR FRAUD OR WILLFUL MISCONDUCT.

18. Indemnity

YOU WILL DEFEND AND COMPENSATE KABKAN LLC FOR CLAIMS, LOSSES AND REASONABLE LEGAL FEES ARISING FROM YOUR CONTENT, YOUR DOCUMENTS AND EMAILS, YOUR DEALINGS WITH YOUR CUSTOMERS, OR YOUR BREACH OF THESE TERMS OR THE LAW, EXCEPT TO THE EXTENT CAUSED BY OUR OWN NEGLIGENCE OR MISCONDUCT.

19. Disputes

Texas law governs these Terms, without regard to conflict-of-law rules.

Before filing a claim, write to legal@kabkan.com and give us 30 days to try to resolve it informally.

Claims must be brought in the state or federal courts in Travis County, Texas, and both parties agree to those courts. Either party may instead bring a claim in small-claims court where it qualifies.

20. General

Changes. We may update these Terms. For a material change, we will email the account address or show a notice in the app at least 30 days before it takes effect, unless a change is needed sooner for legal or security reasons. If you keep using Kabkan after the change takes effect, the new Terms apply. If you do not agree, stop using Kabkan and delete your account.

Notices. We send notices to your account email or in the app. Send legal notices to us by email at legal@kabkan.com. Email notices are effective when sent.

Assignment. You may not transfer these Terms without our consent. We may transfer them together with our business.

Force majeure. We are not responsible for delays or failures caused by events outside our reasonable control.

Severability, no waiver, entire agreement. If a part of these Terms is unenforceable, the rest still applies. Not enforcing a term is not a waiver of it. These Terms and the Privacy Policy are the whole agreement about Kabkan.

Export. You may not use or export Kabkan in violation of US export or sanctions laws.

Survival. The sections on fees owed, the license to your content, disclaimers, liability, indemnity, disputes and general terms survive termination.

21. Language

These Terms are written in English. Translations are provided for convenience. If a translation differs from the English version, the English version controls, to the extent the law allows.
